1. What the Waiver Is

The participant agreement and liability waiver is a mandatory legal document.

Every person who participates in a tandem skydive with Skydive Swahili must complete and sign the waiver before jumping.

No signed waiver means no jump.

The waiver explains:

  • The nature of skydiving.

  • The risks involved in skydiving.

  • The participant’s responsibilities.

  • The participant’s medical disclosure obligations.

  • The legal terms that apply to participation.

  • The release of liability and assumption of risk.

  • The media consent terms.

  • The special requirements for minors.

  • The electronic signature terms.

2. Why the Waiver Is Required

Skydiving is an adventure activity with real risks.

Skydive Swahili follows strict aviation and skydiving procedures, uses professional equipment, works with qualified personnel, and operates with safety as the priority.

However, no skydive can be made completely risk-free.

Unexpected events can still happen because of:

  • Aircraft issues.

  • Parachute equipment issues.

  • Weather.

  • Wind.

  • Turbulence.

  • Human error.

  • Hard parachute openings.

  • Hard landings.

  • Landing area conditions.

  • Participant error.

  • Other operational factors.

The waiver confirms that the participant understands these risks and chooses to participate voluntarily.

Participant agreements and liability waivers are standard practice in skydiving operations internationally.

3. Signing the Waiver Does Not Remove Skydive Swahili’s Safety Responsibilities

Signing the waiver does not mean Skydive Swahili can ignore safety.

Skydive Swahili remains responsible for operating according to applicable aviation, skydiving, equipment, and safety requirements.

The waiver exists because skydiving still involves risk even when proper procedures, training, equipment checks, aircraft checks, and safety measures are followed.

4. Read Before Signing

The waiver is a legal document.

Customers must read it carefully before signing.

If a customer does not understand the waiver, they should ask questions before signing.

If a customer wants legal advice or does not understand the legal effect of the document, they should speak to a lawyer before signing.

5. Assumption of Risk

By signing the waiver, the participant confirms that they understand and accept the risks of skydiving.

These risks may include:

  • Serious injury.

  • Permanent injury.

  • Disability.

  • Emotional trauma.

  • Property loss or damage.

  • Death.

The participant confirms that they still want to take part in the skydive despite these risks.

6. Participant Responsibilities

The participant must:

  • Follow all instructions from Skydive Swahili staff.

  • Follow all instructions from the tandem instructor.

  • Follow aircraft and safety instructions.

  • Provide accurate personal information.

  • Provide accurate medical information.

  • Disclose any relevant health condition.

  • Avoid alcohol, recreational drugs, or impairing substances before the skydive.

  • Avoid unsafe conduct.

  • Avoid interfering with aircraft, equipment, staff, or other participants.

  • Meet the physical and safety requirements for the skydive.

Failure to follow instructions may increase risk and may result in refusal of service.

7. Medical Disclosure Requirement

Participants must provide truthful and complete medical information.

This includes any medical condition, prior injury, surgery, medication, disability, or physical limitation that may affect safe participation.

Relevant conditions may include, but are not limited to:

  • Heart or cardiovascular conditions.

  • Asthma or breathing problems.

  • Seizures, fainting, blackouts, or neurological conditions.

  • Severe anxiety, panic disorder, or psychiatric conditions.

  • Diabetes.

  • Blood pressure conditions.

  • Mobility limitations.

  • Recent injuries or surgeries.

  • Use of medication that may affect judgment, coordination, or physical ability.

If a participant is unsure whether a condition is relevant, they should disclose it and ask Skydive Swahili before jumping.

8. Accurate Personal Information Requirement

Participants must provide accurate personal and contact information.

This may include:

  • Full legal name.

  • Date of birth.

  • Phone number.

  • Email address.

  • ID or passport number.

  • Emergency contact details.

  • Medical information.

  • Any other required safety or identification details.

Accurate information is required for:

  • Safety assessment.

  • Eligibility review.

  • Waiver records.

  • Booking records.

  • Emergency contact records.

  • Communication before and after the jump.

  • Operational and legal documentation.

9. If Information Is Inaccurate

Participants are responsible for the accuracy of the information they provide.

False, incomplete, or misleading information may result in:

  • Refusal of service.

  • Cancellation of participation.

  • Increased safety risk.

  • Incorrect emergency or operational records.

  • Breach of the participant agreement.

  • Reduced or affected legal protection under the waiver.

Skydive Swahili cannot verify every personal or medical detail provided by a participant. The participant is responsible for providing truthful and complete information.

Legal effect depends on the specific facts and applicable law. Customers should speak to a lawyer if they have legal questions about inaccurate information or waiver enforceability.

The waiver includes media consent terms.

By signing, the participant may consent to Skydive Swahili recording, storing, and using photos, video, audio, or other media captured before, during, or after the skydive.

Media may be used for:

  • Safety.

  • Training.

  • Operational documentation.

  • Internal review.

  • Marketing.

  • Social media.

  • Public relations.

Some recordings may be made for safety or operational purposes even if the participant does not purchase a photo and video package.

11. Insurance and Medical Costs

Skydive Swahili does not provide personal accident insurance, medical insurance, disability insurance, life insurance, or travel insurance for participants.

Participants are responsible for their own medical costs if an accident, injury, illness, evacuation, or emergency occurs.

Participants are encouraged to have suitable personal medical, travel, or accident insurance.

12. How to Complete the Waiver

Skydive Swahili uses the Smartwaiver platform for electronic waiver signing.

After completing a booking, the customer receives a waiver link.

Customers are strongly encouraged to complete the waiver before arriving at Skydive Swahili on the day of the jump.

Completing the waiver in advance helps reduce check-in time and avoids delays.

The waiver may also be completed at the Skydive Swahili location on the day of the jump if necessary.

13. When to Complete the Waiver

Customers should complete the waiver after booking and before arrival.

Recommended timing:

  1. Book the skydive.

  2. Pay the required deposit.

  3. Receive the booking confirmation email.

  4. Open the waiver link.

  5. Complete and sign the waiver before jump day.

If the waiver is not completed before arrival, the participant must complete it on-site before they can jump.

14. What Happens If the Waiver Is Incomplete

The waiver must be completed in full.

An incomplete waiver is not valid for participation.

If the waiver is not completed:

  • The participant cannot jump.

  • The participant must complete the missing information before proceeding.

  • Skydive Swahili may delay the participant’s preparation until the waiver is complete.

  • If the waiver cannot be completed, service may be refused.

The electronic waiver system normally prevents submission if required fields are missing.

15. Staff Verification on Arrival

Skydive Swahili staff may verify waiver completion when the participant arrives.

Staff may also check:

  • Participant name.

  • Booking details.

  • Contact information.

  • ID or passport details, if required.

  • Age or date of birth.

  • Medical or safety declarations.

  • Parent or guardian consent for minors.

  • Any information relevant to safe participation.

Skydive Swahili may refuse or delay participation if waiver details are missing, unclear, inaccurate, or inconsistent with safety requirements.

16. Minor Participants

If the participant is a minor, the waiver must be completed by a parent, legal guardian, or adult with lawful authority to sign on behalf of the minor.

The adult signatory must:

  • Provide the minor participant’s information.

  • Confirm their authority to sign.

  • Accept the waiver terms on behalf of the minor.

  • Accept responsibility for the minor’s participation.

  • Provide required identification or relationship information if requested.

A minor cannot participate unless the required adult consent is completed and accepted by Skydive Swahili.

17. Electronic Signature

The waiver may be signed electronically through Smartwaiver.

An electronic signature is treated as a legally binding signature.

The participant may receive an electronic copy of the signed waiver through the email address provided during the waiver process.

Customers must ensure that their email address is correct.

18. Privacy and Record Handling

Information collected through the waiver is used for:

  • Booking management.

  • Safety assessment.

  • Eligibility review.

  • Customer communication.

  • Emergency contact records.

  • Operational records.

  • Legal documentation.

  • Compliance and record retention.

Waiver records may be stored electronically and retained for operational, administrative, or legal reasons.

19. Refusal of Service

Skydive Swahili may refuse service if:

  • The waiver is not signed.

  • The waiver is incomplete.

  • Required information is missing.

  • Information appears false, incomplete, or misleading.

  • The participant appears medically unfit.

  • The participant appears intoxicated or impaired.

  • The participant does not meet safety or eligibility requirements.

  • The participant refuses to follow instructions.

  • Staff identify any safety concern.

No signed waiver means no jump.
